Ken Javerbaum successfully negotiated a $1,000,000.00 settlement against the owners of a strip mall for failing to have parking bollards or guardrails protecting its tenants’ storefronts. Javerbaum pursued a claim on behalf of the estate of a physician who was killed when an SUV crashed into his office. He was able to negotiate the settlement after successfully defeating an application by the strip mall owners to have the case dismissed arguing that there were no laws, regulations or engineering standards requiring bollards or guardrails.
